The Fake flash memory wars are raging. Especially on eBay! It is up to you to make a difference! The frauded buyer can have the last word!

Please report your fake flash memory seller to us. SOSFakeFlash has been fighting the issue since 2008.  Fraudulent sellers are stopped when buyers report.  SOSFakeFlash will investigate and publish a report on the seller.  This helps other victims who have been frauded, it helps them to stand up to the seller and to get their refunds.  When buyers do not report sellers, the sellers continue to sell and fraud even more people.

Seebelow for the information we need. We do not have all sellers of counterfeit and false capacity usb flash drives, mpx players and memory cards on file. Your contribution helps everyone. Your information is registered in our database. We publish and warn others.

Addresses of sellers from your mailing envelopes are very helpful. It helps us to spot conterfeit  fraud rings operating on eBay. Use the search box and type in your sellers id, if there is an article make sure to leave a comment and also your progress in dealing with him.  When we publish your report,  please use the ultimate weapon! Social media.  If you have a facebook account use it to reference an article to warn your friends.  It is the most important way you can contribute and save others from your horrible experience.

As of June 2009, SOSFakeFlash announced a zero tolerance policy.

One confirmation can lead to an alert against an eBay seller. There was no choice considering the number of sellers involved with fake flash memory selling.  Investigators for SOSFakeFlash and the FrankenFlash project are highly trained to spot sellers. There is more than sufficient information on the internet for would be eBay sellers to exercise due diligence.  eBay makes it a policy to insert into each eBay listing that a seller is solely responsible for what they list.

SOSFakeFlash will make no exceptions, regardless of eBay country of registration. Any alert published at SOSFakeFlash will not be removed, whether or not an eBay seller chooses to refund some buyers.  Posturing and threats by eBay sellers are useless, in fact it usually leads to the eBay seller being investigated by eBay and being suspended.  We deal in facts, period.  You help in providing the facts.

Any attempt to claim “defective” will not be be received kindly, genuine flash memory storage chips are manufactured to the highest standards to ensure they can retain capacity, it is one of the reasons true flash memory is expensive.  SOSFakeFlash shows no favoritism.  An eBay seller in the Western world will receive the same treatment as one registered in an Asian country. If a brand name item is in question, an eBay seller must furnish proof from the brand name, attesting to the fact the items they sold were not counterfeit or false capacity.  We expect the brand name to exonerate the seller by testifying the items were indeed “defective”.  We do not expect to receive many emails from the brand name companies as most eBay seller caught did not buy directly from the brand name, nor an authorized reseller, most bought their inventory from Asian wholesaler sites and therefore are at risk of being frauded.  You the eBay buyer, are not responsible for their poor lack of judgment. Your duty is to report the seller, to reduce the fraud for your fellow eBay members.  It is the only way to reduce the fraud and scam eBay continues to permit.  Should you feel sorry for the seller, you do a disservice to other eBay victims, you will contribute the the problem.

To anyone who feels a zero tolerance policy is harsh, we invite you to begin your research and to assess how much money is involved, how much profit and just how many people have lost data and files during the past 9 years on eBay.

We are nearing the end of 2011 and while sellers are being suspended, eBay continues to evade responsibility,  despite the fact the issue is over 9 years old.  Progress is being made, but only when buyers report.  This is where you can matter.  You would be very surprised how a single eBay member was able to stop a seller or even reduce the number of victims.    It is all about making a small indivual effort. That little effort can have very sharp teeth.

  • It is important you test your item to find it’s true capacity. Read: H2testw 1.4 – Gold Standard In Detecting USB Counterfeit Drives
  • Do not assume if you have made a paypal claim and it has been closed that you can not reopen it. Many victims have been forced to do this.  If you funded with a credit card, take a short cut.  After reporting to SOSFakeFlash, contact your credit card company and ask them to do a reversal for fraud.  Credit cards are more concerned about your welfare then eBay ever will be.  You are more likely to get your refund.  It is not something eBay will like and you can be assured that eBay will reclaim their loss by removing the sale from the seller via PayPal. After 3 years of operation and experience we can tell you, the secret to getting your money back is to disregard any eBay claim windows or time limits.  People who are persistent succeed.
  • Do not leave positive feedback in exhange for a refund. You only make the problem worse. Under no circumstances should you fall for blackmail – revise your feedback to optain a refund.   Sellers will try to do this to you.  It is up to you to decide if you are a mouse or if you are someone who will not tolerate fraud.  The revision of feedack is probably why you bought from the seller in the first place! Read: eBay Victims do not leave positive Feedback or change FB to positive to get refunds! Any seller who tries to make you do this is in violation of eBay rules. You can report them!  Send all emails to eBay as your proof – demand your refund and do not accept excuses or email robots.

Any company who had been involved directly or indirectly with a transaction involving fake flash memory items is liable andresponsible. There are no “buts” or “maybe”s. Do not belive any seller ploy of “defective or faulty”, this is the oldest scam in selling fake flash memory!  If you fall for it, you allow more victims for your seller.

It is important you become a registered victim of the eBay flash memory fraud:

If you have confirmed that you have a fake (purchased from eBay) and you wanted it entered into the database as evidence so we can post an alert or update counts against a seller we will need the following information from you:

  1. eBay item number
  2. eBay Seller id
  3. Your eBay Buyer id (d0n’t forget this please)
  4. Your output from H2testw 1.4 or F3 by Michel Machado For Linux
  5. eBay item description title
  6. Seller address complete if you have it (mailing envelopes, eBay, PayPal). Important to build profile and track multiple id’s
  7. Seller email address
  8. A short word of you experience and or thoughts if you like (optional)

Reminder, your eBay Buyer id is NOT  published on the internet when you report in to us. eBay fake flash memory seller ids are published on the internet to warn other buyers.  Keeping your identity confidential is important. It allows us to fight fraudulent sellers aggressively.

If your seller used private auction listings to hide the listing, or a multiple item buy now listing please send a screen capture of the listing to help us cut down on the investigation time.

To capture your buy now listing is very important if the seller is not on file with us (eBay Fake Memory Seller Lists) , if the seller is suspended you will lose your evidence and so could we.

Yes, sometimes one needs a little therapy from the fake flash memory experience. A lot of people feel helpless against eBay and powersellers, nothing is further from the truth. If you are reporting several sellers (it happens) please keep the 1-8 pattern. Easy to understand, the more you save us time the faster we can investigate and enter.

If you do not provide us with the minimun 1-4 we will not investigate nor respond to you.  If you are a genuine buyer it is easy for you to provide the information.

There is no time limit in reporting a seller, you can find a lot of information inside of your paypal account for proof. We have had cases as old as 18 months from purchase being reported. It is why recording in a database is so important.

SOSFakeFlash is very strict about collecting information, data can be support, has witnesses to the fake flash memory deed. The alerts and posts we publish – are based on evidence. Not one post has ever been removed since 2008, despite threats or posturing, can you guess why?

The data we collect is  used to build the list of fake flash memory sellers on eBay. It is also used to issue summary reports on the problem. In your feedback please put the calling card of “SOSFakeFlash” + “H2testw“. It helps people to find us and get help. It unnerves fraudulent sellers as it means their days are now numbered. If you left positive feedback, do a follow up to your original feedback – to let everyone know what you discovered.     The fake flash is really not listed anymore and I am offered a full refund without the need to send the flash back. This should feel like a victory, but there is still that itchy feeling in the back of my head.

    Hi folks,

    An update on my fake 64GB memory pen…..
    PayPal gave me 10 days to return the fake item to the seller, however I declined to do this, since it either won’t get to a valid address or if it did the seller could resell it to some other mug.
    I then filed a complaint to PayPal and quoted the case number. Shortly after they sent me another e-mail stating that I must obtain proof that the item is not genuine from a 3rd unbiased party.
    Fortunately I was able to contact a local computer repair company. They took one look at it, grunted and siad it was fake, even before testing it. The blister back was not sealed, the Sony logo wasn’t the same font and the Grammar wasn’t correct. English obviously wasn’t their first language, and that’s something that Sony would have checked multiple times before manufacture and distribution. The packaging didn’t even mention the stick was 64GB, only mentioned “Micro vault is approximately 32GB(for Windows).”

    Another crazy part of the process is that you have to FAX the information to PayPal… now surely in this day and age you could send them images or even a PDF, I really didn’t understand this archaic way of doing things.

    This is the exact text printed on the back of the packaging:

    “Micro Vault contains a system management area.
    The capacity that can actually be USed(user area)on a 32GB
    Micro vault is approximately 32GB(for Windows).
    To use the device in USB2.0 High Speed Mode, you need to connect it to a
    computer which supports USB2.0,aUSB2.0 card or board.”

    Read the above sentence and see how many mistakes there are:
    * The first line has capital letters for Micro and Vault, but the V in vault on the third does not.
    * The second line says ‘USed’? Shouldn’t that be ‘used’ rather than having U and S as capital ?
    * The second line does not have a full stop, unless the third line is supposed to carry on, but it doesn’t seem very well worded if that were the case. Also, if it was part of the same sentence there is inconsistency between that and another sentence below with regard to line spacing. Lines 1~3 are double line spacing but 4~5 are one and a half.
    * The fifth line doesn’t use spaces correctly “USB2.0,aUSB2.0”, surely there should be a space after the comma and after the ‘a’ ?

    The problem is, despite all this from the buyers point of view, PayPal require you to get independant verification, but a photo and a few screen shots would proove this. I understand they have to adhear to pre-defined rules to go through a process, but there seems too many pits that a buyer could fall down when making a claim and loose out even though it’s obvious you’re being ripped off. PayPal probably need a appeal proceedure should you not win a claim and still feel stongly that you have been unfairly penalised. Or would that be a case to go to a 3rd party to take matters further ? I guess the cost would outweigh the hassle which is maybe why these sellers get away with it ? Though if you consider how many people they’ve scammed, they probably make more profit overall and any refunds they actually do put out wouldn’t really hit their pocket.

    The other irony is, is that PayPal and eBay appear to turn a blind and and at the end of the day they still make profit from these scammers. It begs the question whether they should do more ?

    Anyway, I just need to wait for PayPal to get back to me. Even if the go in my favour I don’t know if I’ll get any money back, as the seller may have closed that PayPal account, so it’ll be sitting waiting for funds to clear forever more.

    Mean time, I bought a 16GB Cruizer stick from Play.com, and tested it fully with H2testw just for my own concerns. It was fine.

    Both new sellers as well and the haigong28 is ridiculous selling every minute….plus he is even lying about his location being in the USA. Haigong28 is a topcon indeed, I would recommend noone buy from them to prevent any casualties

    I have just discovered that I have been sold a fake 32G SD Card thanks to somebody dropping me a line on the ebay sale site. Big thanks to whomever you are for the heads up and the advice on where to go and what to do about it.

    Here is what I have just sent to PayPal to begin the Dispute process…

    Section 13.4 of the Paypal User Agreement states:
    “In the event a seller loses a Claim, the seller will not receive a refund on his or her PayPal or eBay fees associated with the transaction. If you lose a Significantly Not as Described Claim because the item you sold is counterfeit, you will be required to provide a full refund to the buyer and you will not receive the item back (it will be destroyed).”

    The definition of counterfeit is:
    “made in imitation so as to be passed off fraudulently or deceptively as genuine; not genuine;”

    I gave positive feedback immediately on receipt of the item. Talking to Live eBay Support person I have been told that you cant alter a Positive Feedback report so I gave a Follow Up report stating that I had been sold a Fake. The Live Help person told me that the seller was already under investigation but I would put that alongside all the rest of the scripted statements and take the lot with a pinch of salt.

    Has anybody had any luck pushing this problem with any Australian Consumer Affairs body? Be interested in what they say when I ring them on Monday morning.

    Will update when I get any responses. Thanks muchly for this great site.

    Update to my previous 2 posts.

    Paypal sent me an e-mail for further action to the claim.
    They now instruct me:
    “To remain eligible for a refund from PayPal, you must discard the item(s).
    We’re asking you to discard the item(s) because it’s against PayPal policy
    to receive a refund on merchandise that is in your possession.”

    So let me get this straight, Paypal want me to destory/discard any ‘evidence’ to advance the claim.

    I guess in doing so, the seller cannot resell the item.

    Better get my hammer out then.

    Even then that’s assuming they can force the seller (who is probably long gone) to refund. Though, a guide on eBay suggests either the seller or PayPal would refund.

    The wording has “changed”. First, refund and money in your account, then destory. No refund, do not destroy!!!!!

    It is your evidence. If refunded, take the opportunity to open the device. Photograph it. Capture the flash usb controller chip and also the flash memory storage chip.

    In the past, having received a refund, it was necessary to fax a reply signed statement indicating the item was destroyed. Basic CYA for eBay and PayPal regarding counterfeit goods.

    From the message you received, it looks like eBay is generalizing and once again cutting corners.

    Unless and until you have been completely refunded – DO NOT DESTROY.

    If and when you have been refunded, it is correct and fair to destroy the item.

    If you are a person who lost important information to the usb flash drive, memory card or MP Player you may wish to think about keeping the item and fully documenting your loss. The files you lost and the monetary value in pain, suffering and the consequences to you.

    I think Seth’s idea of compiling a list of Chinese consulates around the world (email addresses and mailing addresses) is a good idea.

    The item(s) smashed should be sent to them, until that is the only mail they receive and it buries them.

    Update:

    Paypal decided in my favour and I recieved a reversal refund on the stick.
    Due to exchange rates I ended up getting £1.38 less than I originally paid, but at least I got most of my money back.

    razzor-sharp is asking for trouble. AU $224.90 for a 512GB sony Vaio usb flash drive? There is no such thing as 512GB flash drives, nobody makes them yet. 256GB is the highest capacity so far.     The results from H2testw show a pass. There is always a formatting overhead for the file system.

    For a 4GB card it is a little low indicating a grade C flash memory chip. You can use it, but I would not recommend for taking your most important photos.

    For every day pictures ones you could take again, it is okay.

    Excuse me I want to report mine a fake, I bought a 32gb micro sd card from Grandtechdigital, but I don’t know how to use H2testw thing. Cause I mean it’s NOT NOT NOT a flash drive, it is a micro sd card for phones. I didn’t know how to do it, so I dragged out the storage folder from my phone with the card in onto the desktop and selected that, I think it must’ve been compromised. Since when I tried transferring my pictures from my old phone to new, 279 kb photo only 1 went in, then said max storage. Help!

    Sent the case immediately to PayPal and left negative feedback stating how I tested the drive using h2testw. Looks like this user sold 6 of these same cards before me too… all 32 gb, all around 20 bucks. Silly me, I think I felt a little more confident since the seller was out of NY (US) – fooled me! Check this out though, same card is being sold on Amazon.com right now!

    Well, thanks for all the info on this site, I use the card for recording music and I think we can safely say that figuring out this nightmare now could have very well prevented a bigger nightmare later!

    Your report was received William. Fight hard and do not accept any excuses from eBay.

    Please spread the word where you work and to others. You are in a geo region very vunerable to fake flash memory sellers for several reasons.

    The message needs to get out there. 95% of all flash memory listings on eBay are for fakes. Your seller was shutdown. If you had not reported in, kia6352410 would not be in queue for entry into the database and a formal alert to be issued here.

    kia6352410 will also be on the fake flash memory seller lists we publish here and will remain as glaring evidence of how deep the fraud is.

    There is no way eBay can hope to wiggle or squirm away from the problem, your refund or anybody elses. They have had 8+ years to deal with it, they haven’t.

    Please warn people William, they need to know. Language barriers persist.

    I bought it. It arrived last week. Seemed to work… tested it and just under the first 100MB worked ok, the rest failed.

    Contacted the seller, and started something going on the resolution centre, the seller responded saying if I sent it back to Hong Kong I’d get a refund. I’ve replied saying there’s no way I’m sending it back, he knew it was a fake in the first place. No response yet.

    3 other buyers (there were 200 for this auction) have responded, all of them with positive feedback. I’ve contacted two of them (I did not contact the dude with low feedback or the Spanish buyer) and explained they’ve bought fakes and linked them to the page here which describes the fake. Hopefully they’ll realise before it’s too late.

    Send in your info to sosfakeflash using the report a fake tab ASAP! kiisss6352410 may try to run. 200 buyers is a lot. fb is just starting to come in. You have a chance to use your 5 a day allowance to warn.

    Low FB doesn’t mean an eBay member won’t fight or do something. They can really get fight back sometimes and “tear the house down”. Sometimes there is a bit extra overhead in coaching but it pays off. Not only that, for them, it becomes a positive experience. Somebody cared. It will shape their whole eBay future in a totally different way, a good way.

    Listing described as “New %32GB TF Memory Card Micro SD SDHC MicroSDHC” is interesting. Another wild card character, probably designed to mess the eBay search engines and filters for detection.

    Thanks Kitty. I’ve had one reply from a dude that bought. He’s added a comment to his feedback but it’s still showing as positive.

    The seller has responded 3 times to the dispute. Each time just to say they’ll refund when I send the fake back. I’ve replied each time telling them to refund me and I won’t be sending the worthless fake back. Hopefully eBay will find in my favour at the end of it. They simply must know that these things are fakes.

    He seemed to wait a while before sending the cards, so I’m thinking perhaps he waited until all 200 were sold and then fired them all out at once… which means lots of people should have received theirs… I can’t really tell if they have or not, I suspect many people will not leave feedback right away they will try to sort it out with the seller first.
