I’m HAPPY to report jincai208 has been suspended!!
Maybe this will help my Paypal claim.
Fingers, eyes, and toes crossed. 🙂
BTW…. I recommend everybody take a screenshot (shift+prnt scrn) of the auction your fighting to have a reference to. You just have to remember to keep scrolling down and doing this until you have the whole listing copied and saved as pictues on your computer. That way, if ebay does take the auction off, you have a record of what it actually was.

OBTW,
Thank you to sosfakeflash. I know it’s a lot of hard work keeping up with all of this.
Your doing a great service to everybody!!

Here we go!!!!!
Paypal is insisting I return the drives to the address they have on file.
I told them sending fakes in the mail was illigal but they told me to prove it.
They want me to fax them something written by my local post office stating this.
I really don’t think my post office will comply but I’m going to ask.
I really am going NUTS with this!!
Wish me luck.

Paypal states since they are generic branded items. the fake laws don’t apply.
Any suggestions?

James,
Please see the PayPal Guide we have an escalate to one of the higher email addresses. It appears that PayPal has selected you for the short straw routine.
When memory has been digitally alterned, it is commonly referred as fake memory, as is memory no exist only appear to exist. It is more correct and technical to say “digitally altered” to lie about the real capacity. Unfortuantely that would fly over their heads.
When flash memory chips have been altered to lie about capacity it means files will be lost when the real capacity of the storage chip is exceeded. Data poison.
So would this mean that PayPal is saying you can’t sell toothpaste that is poisoned when it is a brand name but it is okay to sell poisoned toothpaste if it is a no name brand? What are we missing?
It is not unusual for PayPal to select some people for “special” treatment. Read – communication run around torture. They have bad hair days and some of their service agents may have had just a few too many calls from people screaming FAKE!
What matters is not to back down. Recall our worse case, 8 months for “superman”, by the time he finished with PayPal, every item was refunded. No ifs. No buts. No Maybe’s!
Perhaps we should ask PayPal to move their databases to some of these fake flash memory items. After all a 256GB or 500GB usb flash drive pen stick fake has all the room they will need.
This isn’t about being sent a toy radio instead of a real one. It is about the selling of flash memory technology that leads to the loss of information.
If you have a digital camera James and have gentle fingers, open up the usb flash drive, photo graph it, see: https://sosfakeflash.wordpress.com/2009/08/14/proving-a-fake-usb-flash-memory-pen-drive-stick-pen-to-be-false-capacity-a-visual-example-guide-made-easy/
What you are looking for is the little usb square flash chip and also the long flash chip (the memory storage chip). By decoding the full sequence of the storage chip and manufacturer usually people can determine the manufacturer’s stated capacity.
Not recently mentioned, but suggested in the past. If Paypal gives no option but forces a return one could:
1) Include in the envelope the order from PayPal demanding the return of the fake/counterfeit.
2) register it (tracking number PayPal requires)
3) Write very clearly “Return of counterfeit fake memory by Order of PayPal to Fake Flash eBay Memory seller xyz (information documentation inside).
4) Ensure that the full value paid is declared on the envelope (nice customs import duty that fake flash seller will have to pay).
5) Clearly indicate in the customs declaration that you do not wish to break any postal laws but that PayPal is ordering you to do so (why you need to put the documentation inside as the package will probably be opened).
6) If and we say if, a postal employee is actually willing to accept a package so marked, photograph it as it has been stamped as additional proof.
PayPal knows better. In ordering people to return items to these fraudulent sellers, they know they are participating in crime.
One last thing for anyone who does take the risks of returning, we know that if the return address is in fact genuine, the item will be resold. We are asking people to open the items and to etch the truth, on the inner shell casing or on a sticky label to the inner casing. It is called fake flash message in a bottle. One did make it back to the orignal victim so far…
If Paypal has selected to drive you insane… do not let them. Remain rational and just keep hammering back.

Thanks for the info Kitty.
I will keep trying until my blood pressure stops me:-) The person I spoke with said it would have to be confirmed as a fake by a third party. They said H2testw results were not acceptable.
I just made a fake ebay account to use for warning others since I don’t want to risk my long standing account with great feedback.

Hi James,
A 3rd party? Depending on where you live, just go to a friendly computer store, perhaps one that does installs and repairs to PC’s. Explain your story and ask if they would simply confirm you have a false capacity usb flash drive. Have them put something on a company stationary stating it is false capacity.
Have a read through for superman’s final chapter in:
A lot of computer stores hearing the agonies an eBay victim has been put through with eBay and PayPal are happy to obliged. Besides, a lot of technicans will be very interested in looking at a fake first hand. More interesting then installing DVD burners or a new HD.
Note: In the case of superman, the ruling was PayPal had to pay for the cost of testing by a 3rd party. Furthermore, superman purchased generic fake flash usb drives, not brand names.

So, as expected. Paypal closed the dispute in favor of the fraudster.
How do I re-open a case?
The option on the Paypal page is not there anymore.
Thanks,
James

Paypal/Ebay,
First off, let me thank you for retracting your order to return obvious,
and known, fraudulent/digitally altered goods to the seller.
That’s a step in the right direction for your company since doing so
would be breaking the law.
Now as far as me having it appraised at MY cost, I am not willing to
throw good money at bad.
It would cost me near as much as the items cost, to have them evaluated
and documented by a third party, so I would lose anyway.
The program I used, H2testw 1.4 **IS** the third party, (and is also
considered the *GOLD STANDARD* for testing/evaluating
fraudulent/digitally altered memory
devices)
with the test results as the **PROOF**
In the past, when we have sold an item in good faith (even AS-IS items)
and the customer has complained about something,
we have refunded the ENTIRE cost including shipping and allowed the
person to keep the item just to maintain our good name/standing.
It may have cost us some money but we felt it was the RIGHT thing to do.
Maybe we are the exception, and not the rule, but as they say…The
Customer is always right!
Well, I am an Ebay/Paypal customer.
**PLEASE** refund my money as guaranteed by your so called, “buyer
protection program”.
It is about time that Paypal started to protect the innocent buyer and
not support fraudsters. You only have to google this problem to realise
that it is common place and you are doing absolutely nothing to stop it.
Please pull your finger out and stop sending automated replies that do
absolutely nothing for the buyers confidence in you treating this crime
seriously.
Finally, it’s a real shame that Ebay/Paypal takes the side of a
CONFIRMED (by Ebay) bad seller
and still punishes a longtime, loyal member with impecable feedback such
as I.
This is verified by my feedback status and LONGTIME track record with
Ebay/Paypal.

Here is the response I got…..

My name is Cedric and I work for the office of Executive Escalations. I
want to personally thank you for contacting PayPal. Your concerns were
recently forwarded to our office for review in the hope that we might be
able to assist you further.
I understand that you are contacting us regarding the following PayPal
Buyer Protection Claim, in which you are the buyer:
Seller’s Email: ####################
Transaction Date: September 26, 2009
Transaction Amount: -$####### USD
Transaction ID: ##################
Case Number: ##############
After review of your Claim, I see that we initially requested that you
return the merchandise to the seller for a refund. As you indicated
that you did not feel comfortable returning the merchandise, we made an
exception and asked you to provide documentation from a third-party
unbiased source in order to validate your Claim. The Claim was closed
in the seller’s favor since we did not receive valid documentation from
you within the required timeframe.
Because an item is not advertised or listed by our service, we are not
in the position to verify the quality of an item delivered as opposed to
what was advertised or delivered. Please do not misconstrue PayPal’s
request as suspicion that your claim was not valid. As we are an
internet-based business, we do not have the opportunity to review the
relevant items and evidence in question; therefore, we must rely on the
documents described in our request to properly investigate claims of
significantly not-as-described.
As stated within the User Agreement: If you or another User you have
sent money to or received money from initiates a Dispute, Claim or
Chargeback, you agree to provide to any requesting party on a timely
basis any documentation necessary to resolve the Dispute, Claim or
Chargeback. We apologize if you do not agree with PayPal’s decision
regarding this matter; however, the decision was made after a careful
review of all materials available.
We honestly value you as our customer and want to make your experience
with PayPal a positive one. I reviewed your Account and show you have
an impeccable history with us. For this reason, I made an exception to
policy and am crediting you the full $###### USD for this Claim. Please
allow three to five business days to see this amount reflected in your
PayPal balance. Also, please understand this is a one-time exception
and we will be unable to make further exceptions to this policy going
forward.
I hope this information addresses your concerns, and answers any
remaining questions you may have had; however, if you have any
additional questions or concerns, please feel free to contact us
directly at executiveoffice@paypal.com.
Sincerely,
Cedric

Maybe I just complained too much or got a sympathetic person, I don’t know. Either way, they refunded me and I still have the fake drives for later evidence if needed.
Thank you KItty & SoSfakeflash. I will give 10% of the refund to you via Paypal as soon as I find the link on the page 🙂

Thank you for sharing your wonderful news James. We do tell people the secret to success with PayPal is to persist, just not give up! You given a wonderful documented example to all.
Donate Link
You did not find a donate link because one does not exist. We have resisted any financial gain from helping others (not easy to do when times are so hard), but we persist.
If anyone would like to say “thank you” with a small financial offering we suggest:
wordpress.com for making it possible to bring our message to everyone around the world. They offer free hosting, their blogging software is fabulous and their tech support wonderful.
http://wordpress.org/donate/
also toolhaus.org for the wonderful tool they have created to help victims get to the truth about seller feedback. They have a donate button:
http://toolhaus.org/cgi-bin/negs
If anyone is not in a PayPal using mood, just drop a few coins into an outstretched hand that is asking for coffee, tea or a meal.
If you can’t afford anything that is fine too, just offer a smile to a stranger who seems to have a sad or long face (culture permitting).
If you are highly motivated, review our recent alerts, scan feedback for a known fake flash seller and send a few warning messages to buyers to test their items.
Each of us, in our own way can make our world a better place. It begins with one who then become the many. The FrankenFlash project started with just one, concerned for others.
You have already made important contributions James.
You refused to be frauded and fought back. In doing so, you have helped as victims before you have, to make it easier for others to get refunds from PayPal. And you have documented in this article for victims of the present and future to be encouraged.
Once again, thank you!

Thanks again 4 all the help.
