eBayers Pound PayPal Doors For Help Against Fake Flash Seller 3ToTrade
Posted by KittyFireFlash on September 4, 2008
eBayers of Counterfeit USB Drives purchased from 3ToTrade on eBay continue pounding the doors of PayPal for assistance.
At PayPal due to a flaw in the dispute console, eBayers are unable to find an option to report counterfeit merchandise, instead the only option is ” Significantly Not as Described item”. This leads to an automatic response by a robotic responder ordering the eBayer to return the item – blind to the fact it is a counterfeit. It is illegal in most countries to use the Postal System to send or receive counterfeit items.
The robotic emailer is leaving eBayers frustrated and leaves PayPal exposed for future liability. When calling PayPal and speaking directly to a claims agent the position is generally the opposite. We want to know…
There are three ways to contact PayPal:
-
Dispute Console
-
Complaint Response Email Address
-
Telephone
How many different PayPal’s are there? Depending on how you contact PayPal you could easily assume there are different ones. There is no consistency in Responses.
If a person remains in the dispute console this is the kind of order they will get:
Dear FlashDad,
Thank you for contacting PayPal.
Hello my name is Tasha Krista, I am sorry to hear about the situation regarding case number PP-xxx-xxx-xxx, and understand your frustration and concern over this issue. I am happy to assist you with your questions.
If a claim for Significantly Not as Described is decided in the buyer’s favor, we may require the buyer to ship the item at the buyer’s expense to the seller, or to a third party designated by PayPal.
Proof of shipment documents is required. Once PayPal confirms the item has returned to the seller or the third party designated by PayPal, the refund is processed.
To learn the specific terms and conditions of the PayPal Buyer Protection Process, simply click “Legal Agreements” on any PayPal webpage.
If you have any further questions, please feel free to contact us again.
Sincerely,
Tasha Krista

After this future communications will vary. Generally an eBayer is ordered to return the item and submit a tracking number to PayPal. Some eBayers find themselves typing endlessly trying to explain the situation to PayPal. We are not talking about a defective item – we are talking about fraud. Many times now eBayers have asked:
Why are you demanding that I send the crime back to the criminal?
Sadly the eBayer is being victimized a second time.
Contacting By Email to Complaint Response at PayPal.
Many claiming against 3ToTrade after filing a dispute, send an email to the special address we found. Again the communications from PayPal vary.
In some cases eBayers have mentioned the item is a counterfeit. PayPal orders them to have it appraised, investigated and confirmed to be a fake by a third party. They have 10 days to do this and send the supporting documents. We are serious. Fake Flash USB drives have to be examined, appraised, documented by a third party.
Robotic email responder did you not see the original information pasted into the dispute from the testing with H2testw 1.4? Isn’t the software program the “appraiser investigator”?
A 10 day window hangs over the head of the disputing eBayer.
Telephone Contact PayPay
eBayers fighting for refunds from 3ToTrade have called PayPay from both sides of the Globe. Some have had a lot of long distance charges. Why did they do this? After all, the expenses will be more than the cost of the fake flash drive in the first place.
Simple. They are not acting only for themselves. They are responding on behalf of fellow eBayers in countries where the telephone contact costs are too high. Understanding that PayPal has very serious issues in being reached, seeing eBayers being frustrated and worn down by mindless robotic mailers, they are trying to find somebody with actual grey cells between their ears instead of circuit boards and computer chips. A real person – made of flesh and blood.
What do real claims agents at PayPay say? They say not to send the drives back. Not to break the law. Several have even confessed and confirmed that PayPal has a flaw in their system. They then proceed to tell the caller that things will be investigated and they will hear back soon.
The eBayers do hear back from PayPal – from those robotic mindless mailers. Return the drive, so on and so forth – all over again.
However, eBayers are not easily defeated. At least not those fighting against counterfeit flash drives being sold on eBay by fraudulent sellers – they understand the issue. The data loss – the number of people whose data is and will be put at risk if these sellers are not brought to justice and removed from eBay. So PayPal can continue to hear from them and should be aware that they are escalating. Government channels have been contacted and while the wheels could turn at the pace of PayPal in some countries – as least they do turn and move forward!
It is in PayPals interest to start addressing the issue – quickly. Recently they have faced class action suits and lost. It is no ones interest to engage in legal battles. The interest should be in addressing the situation – refunding victims of fake flash, investigating fraudulent sellers brought to their attention by eBayers and having them removed. It is the only way to address fake Flash and counterfeit drives being sold on eBay.
You should also be aware that some eBayers fighting for refunds have been given full refund immediately. Not everyone is being tortured by the robotic mailers. Not everyone is having their cases closed against them as the 10 day windows close. There is no consistency. There is no standard behavior or policy observed at PayPal.
In the meantime as we try to wake PayPal into action, sellers like 3ToTrade dance with glee!
Why? They know PayPals weaknesses and have been merrily exploiting them to make their fake flash profits. It would appear that the fake flash seller have read
Have you read it PayPal? And what have you been doing about it?
Would you prefer to keep people in the dark PayPal, about how sellers can have you at their mercy and buyers with out the protection you advertise?

I didn’t use eBay. I found the same faker on line through their website: kingstonusbcf.com and I paid with PayPal.
I opened a dispute but the kingstonusbcf was no longer in the system (wondering why). Due to that, I immediately escalated it. Here is Paypal’s response 10 minutes after I escalated it:
“Our investigation into your claim is complete. As stated in our User Agreement, the claims process only applies to the shipment of goods. It does not apply to complaints about the attributes or quality of goods received. Therefore, we are unable to reverse this transaction or issue a refund”.

Since my device is just fake, not counterfeit (they never claimed it was an ipod, just 8 gB) that it is legal for me to ship it back and must do so.

Fraud is…
FRAUD! It is not advised to send back. Too many victims have, regareless of the postal laws in their countries. Result? Start reviewing feedback on the fake flash sellers list. Most don’t get a refund. Surprised? Welcome to the real world, the world of fraud. There is a lot of information at this site about what happens to people who actually send the items back.
The result. Forgive my rudeness.
Ha ha ha!
The fake flash seller just sells it to somebody else and claims they never recieved it.
The issue is time. Burn your reclaim days. Ensure you miss your claim windows with paypla.
1) Never agree to send the item back
2) Tell paypal know you are willin to send to THEM for testing.
3) Never withdrawl your negative feedback. If you do this in exchange for a promise of refund you lose any future voice as you can not change again. We see too many victims naive enough to do those. End result? You are sc*wed. You also allowed for more victims to be created. And you can sing in the wind for a refund. Who pays in the end? You do, dear victim>/strong>. So do current and future buyers. Is this what you want?

This brings back memories! Has anything changed? Obamastores is still going strong.
The Don of fake flash in the orient. Fakeflashnews just published an undercover story, a visit to the Don’s address.

It looks like obamastores is no longer a registered user, can this be true?

Yep. It is true. WOW!
To everyone who worked on obamastores recently, congratulations! That was a quickie. Given how long this seller was frauding, the damage has been done to so many.

probably shook a few screws loose. Not every day the Don Of Fake Flash gets a photo visit.
The obamastores id may be suffering a suspension, the issue is for how long? An id with a score over 11,000 is likely to turn to service. Most likely in a few months.
Patrol, patrol, patrol on eBay. We suspect they may have just cracked open a new id or pressed another id not selling fake flash memory products into service, taking over where obamastores left off. THAT IS HOW IT WORKS.

I’ve don a simple thing after all to run around by Paypal; block them from with drawing any money from my account.
Go to my bank with all the documents and my bank agreed with what happened – fraud and reveresed the charge to my account.
Since Paypal is the “merchant” according to the transaction record “Paypal” is responsible.
I finally got my money back and started to get threat e mails from Paypal for violation of the user agreement in regards to chargebacks.
WELL TOUGH.. They also kept banging against that block on my account trying to get the money back; but were stopped.
NOW PAYPAL HAS TO GO AFTER THE FRAUDULANT SELLER THEMSELVES TO GET THE MONEY BACK FROM THEM. Yea Fat Chance..
The one real bad thing out of all this is the block is only good for six months; so I had to close the account and re opened a new one; a real pain in the butt; but I got my money back
Paypal can go suck..
